Groundbreaking Arbitration Award: Jose Batista v. Robinhood Financial, LLC and Robinhood Securities, LLC
August M. Iorio secured a groundbreaking arbitration award for a retail investor against Robinhood. This award is notable because it is the first win by a retail investor against Robinhood over its decision to restrict the trading of certain “meme stocks” on January 28, 2021, marking a monumental and historic win for retail investors.
The investor, a 27-year-old truck driver, invested in shares of KOSS and EXPR late in the day on January 27, 2021. He suffered significant investment losses when Robinhood prevented its users from purchasing new positions pre-market on January 28, 2021, and the share prices of the securities tumbled. New York securities arbitration attorney August M. Iorio represented Mr. Batista throughout the FINRA arbitration process. Robinhood was found liable by an independent arbitrator, and the investor was awarded compensatory damages and interest, with all forum fees assessed to Robinhood.

Holding Control Persons Accountable: Linda Smith v. Michael Frager and Joshua Helmle
August M. Iorio secured an arbitration award against an individual who formerly owned and controlled a brokerage firm in California. The award is notable in that the arbitration panel found the individual liable for the firm selling a risky and speculative GWG L Bond to a customer. At the arbitration hearing, Mr. Iorio argued that the individual control person was liable under California law as a “control person” of the firm.

Significant Recoveries for GWG L Bond Investors: $3.5 Million
August M. Iorio recovered millions of dollars (over $3.5 million) for investors who purchased illiquid, speculative, high-risk, and high-commission GWG L Bonds. These recoveries involved claims against over 25 different brokerage firms across the country

Championing Puerto Rico Bond Investors: Over $80 Million Recovered
August M. Iorio played a key role in helping investors in Puerto Rico recover over $80 million from broker-dealers. These firms had improperly recommended and over-concentrated their customers’ accounts in Puerto Rico bonds and Puerto Rico Closed-End Funds.
